What do I need?
Memorandum of Lease / Memorandum of Transfer
The lands in Samaan Grove Development are leasehold properties (999 year-leases) registered under the Real Property Ordinance (R.P.O.), Chapter 27 No 11 of the Laws of Trinidad and Tobago.
As such, each property within the development will be governed by the memorandum of lease and subsequent memorandum of transfer for each re-sale conducted within the development. If you are considering a re-sale, this document must be available along with your certificate of title, as this shows the legal ownership of your respective property.
Certificate of Title – Original
Land title documents serve as evidence of ownership of a piece of property. They should be registered with the Land Registry, Registrar General’s Department of the Ministry of Attorney General and Legal Affairs. A Certificate of Title, under RPO Law, is the same as a Deed under Common Law. See example below.
Certificate of Assessment
If you do not possess your certificate of assessment, you may still have to file your return of ownership at the Board of Inland Revenue District office in Scarborough, Tobago. To request a copy of your return of ownership document, please click here to request a copy.
Upon receipt of your return of ownership, the seller must physically visit the BIR office in Scarborough, Tobago, to file the return of ownership and apply for the certificate of assessment for the respective property.
The Board of Inland Revenue would request an assessment number for the overall estate if this were not done previously. To facilitate, these are the Assessment numbers that cover the Samaan Grove Development.

The Board of Inland Revenue usually advises that this process can take approximately three (3) weeks from submission.
WASA Clearance Certificate
Once the seller has obtained their tax assessment certificate, the next step will be to apply for the WASA Clearance for their respective property. Upon completing the WASA Clearance request, WASA will advise of any outstanding charges on their property. Once all payments are deemed current, WASA will issue a receipt and a WASA Clearance for the property.
Share Certificate
Effective 2023, all share certificate requests/reprints are processed electronically by Samaan Grove Community Association Limited. To facilitate this request, the re-seller must submit a copy of the regulatory documents, including the memorandum of lease/transfer.
Once submitted, this request will take approximately one (1) week. Upon completion, the digitally signed, stamped and issued share certificate will be emailed to the homeowner and attorney-at-law on record for the re-sale.
Lease Rent Payments
For all “A” properties within Samaan Grove Development, Occidental Investments Limited (OIL) bills an annual lease rent of $1000.00, due and payable on the 1st of each year. Occidental Investments Limited will email a copy of the receipt with the original posted to the address on file for the property.
For all “B” properties within the Samaan Grove Development, Samaan Grove Community Association Limited (SGCAL) bills an annual lease rent of $1000.00, due and payable on the 1st of each year. SGCAL issues a payment clearance for the lease rent paid on Phase “B” properties for resale purposes. Samaan Grove Community Association Limited will email a copy of the receipt with the original forwarded to the homeowner.
For resale purposes, the re-seller must have a copy of their lease rent receipt as part of their closing documentation.
Service Charge Payments
All service charges are paid to Samaan Grove Community Association Limited for the period/financial quarter up to the closing date of the re-sale. As the Management Company, SGCAL will issue a receipt and a payment clearance certificate for the respective property up to the closing date.
Consent from the Lessor, Occidental Investments Limited, to the proposed assignment
Phase “A” properties
To facilitate this request, the reseller and their representative must submit the following documents to Occidental Investments Limited and Samaan Grove Community Association Limited.
- Registered Memorandum of Leaser or Memorandum of Transfer for the Current Owner.
- Executed Sales Agreement.
- Financial Clearance Document.
- Lease Rent Receipts.
- Attorney-at-law on record for the re-sale.
This request will take approximately three (3) weeks to prepare and process after receiving and verifying the documents listed above. Upon completion, the originals will be submitted to the attorney-at-law via registered mail from Occidental Investments Limited.
Notation—Although the “consent to resale and/or waiver of construction” does not incur a financial cost, all service charges and lease rent payments must be updated to proceed with this request.
Phase “B” properties
To facilitate this request, the reseller and their representative must submit the following documents to Samaan Grove Community Association Limited.
- Registered Memorandum of Leaser or Memorandum of Transfer for the Current Owner.
- Executed Sales Agreement.
- Financial Clearance Document.
- Lease Rent Receipts.
- Attorney-at-law on record for the re-sale (email).
Once submitted, this request will take approximately one (1) week. Upon completion, the digitally signed, stamped and issued consent to lease will be emailed to the homeowner and attorney-at-law on record for the re-sale and registration purposes.
Notation – The attorney-at-law on record for the identified re-sale can print the electronic copy on file for their respective submission to the Lands Registry.
